The General Data Protection Regulation (GDPR) is the EU’s new data protection legislation. This replaces the Data Protection Act 1998 and will introduce tougher fines for non-compliance and breaches of GDPR.
GDPR came into force on 25th May 2018.
Although the UK is due to leave the EU on Friday 29th March 2019, businesses are still expected to comply with the GDPR.
With maximum fines for non-compliance up to €20 million or 4% of annual global turnover, whichever is higher, it is important to take this new legislation seriously.
GDPR applies to any business that handles or stores personal data of EU residents, regardless of you being a ‘controller’ or ‘processor’. This includes data relating to your customers, staff or suppliers whether it’s been captured via online forms, events, telephone marketing or even ‘bought in’ lists; without exception. You must ensure all data your organisation keeps has been collected legally and according to GDPR compliance.
The ICO (Information Commissioner’s Office), will be enforcing the GDPR in the UK. They are the UK’s independent authority set up to uphold information rights.
